A Special Legal Training Seminar has been scheduled to quickly train North Carolina law enforcement agencies on the Supreme Court’s June 23 ruling in Rothgery v. Gillespie County Texas.

This seminar will provide discuss compliance with this key ruling. The practical impact of Rothgery is that officers will now have to comply with the complex rules surrounding the Sixth Amendment right to counsel once an arrestee is presented to a magistrate for an initial appearance.  As the Sixth Amendment right to counsel is offense specific, rather than custody specific, these rules will apply whether the suspect is in custody or has been released on bail. The new Rothgery requirement raises significant issues both with post-initial appearance interrogations, and with certain identification procedures.
